Terms for using our sites

These terms cover your use of our two websites, ibgfortified.com and bestfortifiedpay.com (our "sites"), which are operated by Best Pay LLC, Fort Worth, Texas ("Best Pay", "we", "us"). By using either site, or by applying, booking or buying through it, you agree to these terms. If you do not agree, please do not use the sites.

Information, not legal advice

Everything on our sites is general information. It is not legal, tax, accounting or financial advice, and using a site or its tools does not create an attorney-client or any other professional relationship. Best Pay LLC is not a law firm. Whether and how to use a receipt, a timestamp or a report in any matter is for you and your lawyer, and whether a court accepts anything is for the court. Please do not rely on our sites in place of advice from a professional who knows your situation.

What our tools do and do not do

A receipt or timestamp can show that a sealed record has not changed since it was sealed and, with a timestamp, that it existed no later than a stated time. It does not show that a file is true or genuine, who made it, or that it was unaltered before it was sealed. Our verifier and exports perform a technical check and report the result. You are responsible for reading the result and the limits shown with it and for deciding whether and how to rely on it. We make no promise about the outcome of any matter.

Our two sites

ibgfortified.com is our evidence site: information, free tools and the pilot. bestfortifiedpay.com is where Best Pay offers its packages and products and runs the Watertight Integrity marketplace. Watertight Integrity Best Pay is the name under which Best Pay LLC operates that marketplace and Best Pay's own products. It is not a separate company, and Best Pay LLC is the party to every contract with you. Anything you buy from Best Pay is arranged through bestfortifiedpay.com or by email with us, and is covered by its Refund Policy as well as these terms. Pilots, and any custom sealing, timestamping or evidence-report work, are provided under a separate written agreement that states what we receive, what we deliver and the fee. If that agreement conflicts with these terms, it controls for that work.

Using our sites

You may use our sites for lawful purposes, including checking receipts for your own matters or your clients' matters. Please do not submit false information, impersonate someone else, disrupt a site, overload it, or probe it for weaknesses without asking first. If you find a problem, we welcome a report at ibg@bestfortifiedpay.com; our security contact is also published at /.well-known/security.txt on each site. Requests that look like scanning, probing or attack may be blocked, by us or by Cloudflare, which delivers our sites, and we may report them to law enforcement. We may decline an application or request, or suspend access, for violations of these terms. You may link to our sites.

Ownership

The text, design and software of our sites, and the names of our products, belong to Best Pay LLC or are used with permission. Some of the technology described on our sites is the subject of pending intellectual-property filings. These terms give you the right to use the sites and their free tools, and to use what you buy under its own terms. They do not give you any other right in our software, our filings or our trademarks, and you may not copy the sites or their tools and present them as your own.

Third-party services

Some features rely on services we do not run, such as the network that delivers our sites, payment processors and a free timestamp authority, and we may add others, such as a public blockchain. Those services carry no uptime or accuracy promise from them or from us, and they may change or stop without notice. If you pay through a payment processor, its own terms apply to that payment too.

Provided as is

Our sites and their tools are provided "as is" and "as available". To the fullest extent the law permits, we disclaim all warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, availability and non-infringement.

Limitation of liability

To the fullest extent the law permits, Best Pay LLC and its owners, employees and contractors are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, lost business, or the loss, exclusion or weakening of any evidence, claim, defense or case, arising from your use of, or inability to use, our sites or their tools, from anything you book or buy through them, or from work done by anyone listed on or found through them, even if we were told such loss was possible. Our total liability for all claims about our sites and what you buy from us is limited to the greater of one hundred U.S. dollars or the amount you paid Best Pay LLC in the twelve months before the claim arose. Nothing in these terms limits liability for fraud or willful misconduct, or any liability or right that cannot be limited or waived by law. Work done under a separate written agreement is governed by the limits in that agreement.

Your responsibility for what you do

You are responsible for how you use our sites and tools, for the accuracy of anything you submit or rely on, and for following the rules that apply to you and your matter. To the extent the law permits, you agree to cover Best Pay LLC against third-party claims that come from your misuse of the sites or from your own unlawful conduct.

Governing law and where disputes are heard

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute about these terms or our sites will be heard only in the state or federal courts located in Tarrant County, Texas, and you and we agree to those courts' jurisdiction. Before either of us starts a case, we agree to try for 30 days to resolve it by writing to each other.

General

If any part of these terms cannot be enforced, the rest stays in effect. Our not enforcing a term at some moment does not waive it. These terms, together with our Privacy Policy and our Refund Policy, are the whole agreement between you and us about our sites, apart from any separate written agreement for work we do for you.

Changes

We may change these terms. We will change the date above and post the new version here. Continued use of the sites means you accept the change.
